TERMS OF USE, LEGAL DISCLOSURES, AND PRIVACY POLICY AGREEMENT

This instrument (“Terms”) governs access to, navigation of, and acquisition of the digital asset made available within this environment (“Platform”), establishing rights, obligations, limitations, and responsibilities between the user (“User”) and the project owner (“Author”). By accessing, browsing, or engaging in any interaction with the Platform, the User declares, for all legal purposes, that they have read, understood, and fully agreed—freely, knowingly, irrevocably, and irreversibly—to all provisions set forth herein, undertaking full compliance therewith, including on an international basis.

The legal nature of the asset made available is strictly artistic, conceptual, and digital, and shall not, under any interpretation, be characterized as a financial asset, security, collective investment instrument, derivative, participation contract, promise of return, debt instrument, or any modality subject to financial or capital markets regulation. The acquisition of such asset does not grant the User any future economic rights, revenue participation, expectation of appreciation, liquidity, repurchase rights, profit distribution, or any other form of direct or indirect financial return. The User expressly acknowledges that the decision to acquire the asset is subjective in nature, based exclusively on personal criteria of aesthetic, symbolic, or conceptual appreciation, with no inducement, promise, or guarantee made by the Author.

It is expressly established that this project has not been conceived, structured, or made available for speculative purposes, nor is it related to active trading practices, arbitrage, financial intermediation, or any dynamics typical of secondary markets. Any resale, assignment, transfer, or circulation of the asset conducted by third parties shall occur at their sole risk and responsibility, without any involvement, control, participation, or liability on the part of the Author. Such events shall be deemed external, autonomous, and legally independent.

With respect to audiovisual content that may be displayed on the Platform, the User acknowledges that certain materials may originate from third parties and may be incorporated through legitimate technical means, such as embedding, while remaining hosted in their original environments. Such content is used solely for illustrative, informational, or contextual purposes, with proper attribution, where applicable, to their respective rights holders, and does not, under any circumstances, imply transfer, assignment, or claim of copyright by the Author. In the event of a formal claim of ownership or dispute, the Author reserves the right to remove such content without any admission of liability.

Additionally, the User acknowledges that certain visual and audiovisual content may be produced using artificial intelligence technologies. Such materials are generated originally, without intent to improperly reproduce protected works. The Author declares adherence to legal and ethical principles applicable to the use of such technologies but assumes no responsibility for external interpretations regarding similarity, aesthetic perception, or subjective claims.

All proprietary elements associated with the Platform, including but not limited to creative conception, narrative structure, texts, visual identity, conceptual architecture, as well as the voice used in institutional content, constitute the exclusive intellectual property of the Author, protected under applicable national and international laws. The voice, in particular, is recognized as biometric data and a personality attribute, and its reproduction, cloning, synthesis, manipulation, or unauthorized use—by any means, including technological processes or artificial intelligence systems—is expressly prohibited. Any violation shall result in the immediate adoption of appropriate legal measures in the civil, administrative, and, where applicable, criminal spheres.

The Platform is provided on an “as is” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of fitness for a particular purpose, continuous availability, absence of errors, or conformity with the User’s subjective expectations. The Author shall not be liable for any direct, indirect, incidental, consequential damages, or loss of profits arising from the use, interpretation, or inability to use the Platform or the asset made available therein.

With regard to personal data protection, the Author declares that, where applicable, they observe the principles and guidelines established by Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR), adopting reasonable technical and organizational measures to protect collected information. Limited personal data may be processed, such as basic identifiers, browsing data, IP address, and technical information, for the purposes of enabling Platform operation, ensuring security, preventing fraud, and, when necessary, establishing institutional communications. The User acknowledges that such data may be processed by contracted data processors strictly within the limits necessary for the execution of Platform activities, and no personal data is sold.

The User, as a data subject, may exercise their rights of access, correction, or deletion in accordance with applicable law, upon formal request, subject to relevant legal and regulatory limitations. The Author undertakes to adopt proportional measures to safeguard the confidentiality, integrity, and availability of information.

This instrument shall be interpreted in accordance with the principles of good faith, legality, and private autonomy, and, where applicable, the laws of the competent jurisdiction shall apply, without prejudice to compliance with international standards relating to data protection, intellectual property, and the digital environment. Any tolerance regarding the breach of any provision shall not constitute novation or waiver of rights, and the enforceability of all provisions herein shall remain unaffected.

By continuing to browse or engage in any interaction with the Platform, the User reaffirms their full agreement with these Terms, expressly acknowledging the artistic nature of the asset, the absence of financial purpose, the limitation of the Author’s liability, and the full legal validity of this instrument.
